Welcome to Encryptescrow.com. By accessing our website and using our escrow services, you agree to be bound by the following rules and terms. Please read them carefully.

1. Acceptance of Terms
Your use of our Services constitutes your acceptance of this Agreement and our Privacy Policy. If you do not agree to all terms, you must not use our Services.

2. Our Role as Escrow Agent
We act as a neutral, third-party intermediary. We do not:

  • Act as an agent for either the Buyer or the Seller.

  • Verify the quality, legality, or authenticity of the items or services in the underlying transaction.

  • Provide legal, financial, or tax advice.

  • Guarantee the identity of any user.

Our obligation is limited to holding the digital assets (Escrowed Funds) and releasing them strictly according to the joint instructions of the transacting parties or the terms of the specific escrow instruction.

3. User Eligibility
To use our Services, you must:

  • Be at least 18 years of age.

  • Possess the legal authority to enter into a binding contract.

  • Not be a resident of or located in a jurisdiction where our Services are prohibited by law. (North Korea and Antarctica)

  • Not be on any restricted lists (e.g., OFAC sanctions lists).

We reserve the right to refuse service to anyone at our sole discretion.

4. The Escrow Process: Rules of Engagement
A. Transaction Initiation:

  • All terms of the sale (price, asset description, inspection period) must be agreed upon by the Buyer and Seller before initiating escrow.

  • The party responsible for the escrow fee must be clearly designated.

B. Funding the Escrow:

  • The Buyer must send the exact amount of cryptocurrency to the unique, multi-signature wallet address generated by our platform for the transaction. We can manually provide wallet address in situations of technical challenge.

  • Sending funds from an exchange is prohibited and may result in loss of funds. Funds must be sent from a private wallet you control.

  • We are not responsible for funds sent to the wrong address or via the wrong network.

C. Inspection Period:

  • The Seller must fulfill their obligation (e.g., deliver goods, provide services) as described in the transaction.

  • The Buyer has a defined period of  72 hours from the Seller’s marked fulfillment to inspect and either approve or dispute the transaction.

  • If the Buyer does not take action by the end of the inspection period, funds will be automatically released to the Seller.

D. Disbursement:

  • Funds will only be released to the wallet addresses provided and verified during the transaction setup.

  • We will disburse funds according to the agreed terms or a mutual release instruction from both parties.

5. Dispute Resolution

  • If a dispute is raised within the inspection period, all funds will be frozen.

  • Both parties must provide requested evidence; proof of shipment, screenshots of communication, proof of non-conformity to our support team within 5 business days.

  • Our team will act as a neutral arbiter. Our goal is a fair outcome based on the evidence provided.

  • Our decision is final and binding for the disposition of the escrowed funds. By using our service, you agree to abide by our decision.

  • We are not liable for any losses beyond the value of the escrowed funds in the transaction under dispute.

6. Prohibited Activities
You may not use our Services for transactions involving:

  • Illegal goods or services (e.g., drugs, weapons, stolen items).

  • Fraud, money laundering, or terrorist financing.

  • Ponzi schemes, pyramid schemes, or any other financial scams.

  • Adult content or services without proper legal compliance.

  • Items that infringe on intellectual property rights (e.g., counterfeit goods).

  • Any activity that violates applicable law.

7. Fees

  • Our fee structure is calculated based on the amount held in escrow, the duration of the transaction and the type of cryptocurrency. Contact customer service to know more

  • Fees are non-refundable once a transaction has been funded, except at our sole discretion.

  • Fees are typically deducted from the escrowed funds before disbursement to the Seller.

8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ENCRYPTESCROW SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

  • LOSS OF PROFITS, DATA, OR GOODWILL.

  • DAMAGES ARISING FROM:

    • USER ERROR (E.G., INCORRECT WALLET ADDRESS).

    • BLOCKCHAIN NETWORK FAILURES, DELAYS, OR FORKS.

    • MARKET VOLATILITY AND FLUCTUATIONS IN CRYPTOCURRENCY VALUE.

    • UNAUTHORIZED ACCESS TO YOUR ACCOUNT DUE TO YOUR FAILURE TO SECURE YOUR CREDENTIALS.

OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE TOTAL FEES WE EARNED FROM THE SPECIFIC TRANSACTION IN QUESTION.

9. Modification of Terms
We reserve the right to modify these Rules and Terms at any time. Changes will be effective upon posting to our website. Your continued use of our Services after changes are posted constitutes your acceptance of the modified terms.

10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United States of America and the State of California, without regard to its conflict of law principles.
